General Terms & Conditions

1. Scope of application, customer information

These general general terms and conditions (hereinafter "GTC") regulate the contractual relationship between Susanne Frühauf, acting as "HybridPunkBerlin" (hereinafter "Seller") and consumers (hereinafter "Customer") who purchase goods via the shop www.hybridpunkberlin.com.

 

2. Conclusion of contract 

2.1. The product descriptions in the online shop represent a non-binding offer to the customer and serve to make a binding offer by the customer. 

2.2. The customer can put one or more products in the shopping cart. During the ordering process, you enter your data and wishes regarding payment method, delivery terms, etc. Only when you click the order button do you accept the offer to conclude a purchase contract. 

2.3. The confirmation of receipt sent immediately by email simultaneously declares acceptance of the offer and the purchase contract is thus concluded. 

2.4. If you choose a payment method offered by PayPal, payment processing will be carried out via the payment service provider PayPal (Europe) S. à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "Paypal"), subject to the PayPal terms of use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - subject to the conditions for payments without a PayPal account, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full

 

3. Storage of the contract text

The order with details of the concluded contract (e.g. type of product, price, etc.) is stored by the seller. The general terms and conditions are sent by email, but can also be accessed at any time after the contract has been concluded via the website. Registered customers can access their past orders via the customer login area.

 

4. Delivery and shipping conditions

4.1. The customer must ensure that the data he provides for order processing is correct so that the goods and messages sent by the seller can be received. When using SPAM filters, it must be ensured that the emails sent by the seller can be delivered.

4.2. Delivery is made to the delivery address provided by the customer. If delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result.

 

5. Prices and payment terms

5.1. The prices stated are total prices. Since the seller is a small business according to Section 19 Paragraph 1 of the VAT Act, no sales tax is charged due to the tax exemption. Additional delivery costs are stated separately in the respective product description

5.2. Depending on the country in which the buyer is located, additional costs may arise which the customer must bear.

5.3. If the customer chooses a payment method offered via "Shopify Payments", the payment is processed by the payment service provider Stripe Payments Europe Ltd., Grand Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter "Stripe"). 6. Right of withdrawal

6.1. The buyer is generally entitled to a right of withdrawal. Further information can be found in the seller's cancellation policy.

6.2. The right of withdrawal does not apply to goods that are tailored to the personal needs of the consumer. 

6.3. The right of withdrawal does not apply to consumers who are not members of a member state of the European Union at the time the contract is concluded and whose place of residence and delivery address is outside the European Union.

 

7. Reservation of proprietary rights

The goods remain the property of the seller until the purchase price owed has been paid in full.

 

8. Statutory liability for defects

Statutory liability for defects applies to the goods offered.

 

9. Limitation of liability

The seller excludes liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by vicarious agents and legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to the customer and to give him ownership of it.

Otherwise, the seller's liability is excluded.
